SAFR personnel must maintain strict confidentiality of all patient medical records. Unauthorized disclosure of patient information is prohibited and may result in disciplinary action.
Disclosure Guidelines
General Rule
- Do not disclose any individual's medical record to anyone other than the patient themselves.
Exceptions for Disclosure
- Emergency Contacts
- Information may be shared with a patient's designated emergency contact only if: a. The patient is unresponsive, or b. The patient is not of sound mind to make medical decisions.
- Law Enforcement Requests
- All law enforcement requests for medical records must be directed to SAFR command.
- Non-command personnel must immediately inform command if approached for medical records.
- Records can only be released to courts or law enforcement with a valid subpoena.
- Release of subpoenaed records will be handled by a Doctor or command member.
- Preventing Serious Threats
- Information may be disclosed to law enforcement to prevent a serious threat to others.
- Mandatory Reporting
- SAFR personnel must report cases of abuse or neglect to law enforcement.
- Death Investigations
- Information may be disclosed to notify law enforcement about an individual's death if it may have resulted from a crime.
- Fugitive Identification
- Information may be disclosed to law enforcement to identify an individual who appears to have escaped from police custody.
Procedure for Handling Disclosure Requests
- Verify the identity and authority of the requesting party.
- For non-emergency situations, consult with SAFR command before disclosing any information.
- Document all requests for information and the response provided.
- When in doubt, err on the side of patient privacy and consult with command.
Training and Compliance
All SAFR personnel will receive regular training on medical privacy laws and this policy. Violations of this policy may result in disciplinary action, up to and including termination.
